VITA Equestrian and our services and activities. This website is owned by Ethikos Professional Services LDA, located at Rua Engenheiro Carlos Santos, 28, Montemor, Loures, with VAT number 510969054.
In conformity with Portuguese Laws.


1. APPLICATION

1.1 These General Terms and Conditions apply to all visitors of the VITA Equestrian website, www.vitaequestrian.com (hereinafter referred to as the “Site”), and to any other commercial transactions conducted through the Site’s online store.
By browsing the site and purchasing any product through it, you accept these General Terms and Conditions of Contracting and Use as a User and Customer.
Before placing an order on our Site, please read these Terms carefully and print or save a copy for future reference.
Ethikos Professional Services LDA reserves the right to review and amend the General Terms and Conditions at any time without prior notice, ensuring compliance with Decree-Law 24/2014, of 17-02, as amended by Law 47/2014, of 28-07.

 

2. INFORMATION ABOUT CONTENTS

Reproduction, transfer, distribution, or storage of the contents of the website www.vitaequestrian.com without prior written authorization from Ethikos Professional Services LDA is prohibited for purposes other than strictly personal use.
Every effort has been made to ensure that the presented information is free of typographical errors. However, if such errors occur, Ethikos Professional Services LDA will promptly correct them. Obvious errors, such as price errors, calculation errors, or typographical errors in offers, promotions, folders, brochures, catalogs, order confirmations, invoices, and other written statements from Ethikos Professional Services LDA are not binding.
The product photographs displayed on the website are for illustrative purposes only. Therefore, Ethikos Professional Services LDA recommends that the Customer consults the detailed description of the product to obtain complete information about its characteristics and requests more accurate information if desired.

 

3. OFFER AND AGREEMENT

3.1 The offers and promotions on the Site do not imply any obligation. By completing your order on the Site, you are making a binding offer to purchase the product(s). All orders are subject to acceptance by Ethikos Professional Services LDA, and the agreement between you and Ethikos Professional Services LDA will only be formalized when Ethikos Professional Services LDA begins fulfilling the contract. If the ordered products are no longer available or out of stock, Ethikos Professional Services LDA will inform you of this fact and reject the order. If possible, we may propose alternative products of similar nature and quality as a replacement.
3.2 The prices displayed are in euros. The availability of the products presented on the Site is limited to the stock available at any given time.

 

4. DELIVERY COSTS

Delivery charges will be applied for the ordered products. There is no possibility to refuse delivery or the related costs. The delivery fee is indicated on the Site.

 

5. PRICES, PAYMENT

Article 4 of Decree-Law 24/2014, of 17-02, as amended by Law 47/2014, of 28-07
5.1 The applicable prices are the prices of the products displayed on the Site. All products indicate the price with VAT and without VAT in euros. Delivery costs, as well as any other additional costs, are indicated separately on the Site.
5.2 Payments can be made by:
a) Bank Transfer
b) PayPal
c) Debit/Credit Card

5.3 In exceptional cases, Ethikos Professional Services LDA may restrict payment to Bank Transfer only.
5.4 Bank Transfer:
After placing your order, you will receive a confirmation email that includes the banking information of Ethikos Professional Services LDA, so you can proceed with the transfer. After completing the transfer, please send an email to info@vitaequestrian.com with the proof or confirmation, mentioning the order number. The banking information will be provided during the checkout process on the Site. Your order will be processed once we receive the payment, in case you choose bank transfer as the payment method.

5.5 PayPal:
Upon completion of the order, the payment process will begin. If you choose PayPal as the payment method, you will be redirected to the PayPal page where you can confirm the purchase.
5.6 Debit/Credit Card:
Upon completion of the order and initiation of the payment process, if you choose this payment method, the necessary data will be provided to you to complete the payment.

5.7 The order will be processed once we receive confirmation of payment, regardless of the chosen payment method.

 

6. DISCOUNTS

6.1 The validity period of the presented promotions is indicated on all product pages. You can click on “promo info” next to the promotion to view it.
6.2 Promotional discounts will be applied if the order is finalized by the user through the checkout process and paid within the announced period.
6.3 Saving a product in the shopping cart does not guarantee the price or discount if the conditions mentioned in the previous point are not met.

 

7. DELIVERY / COLLECTION

7.1 Ethikos Professional Services LDA will make an effort to inform you about the estimated delivery dates shortly after order completion. However, the maximum delivery period will never exceed 60 days.
7.2 The delivery period starts on the day the contract is concluded, as stated in Article 3.1, unless expressly agreed otherwise between the parties.
7.3 If any item is damaged or missing from your order, please contact us within 5 days of delivery at +351 912295590 or email info@vitaequestrian.com. If any product is found damaged upon delivery, please inform the carrier’s representative at the time of delivery. The product will be collected within 14 days from the day the customer contacts us unless otherwise agreed upon.
7.4 The products are delivered to the specified location at the time the order is placed. Ownership of the goods passes to the customer upon full payment of the price and any other amounts. The risk of loss or damage to the goods is transferred to the customer at the time of delivery.
7.5 The Products will be delivered (via a carrier) to the address provided by the customer. If you choose to place your order in multiple order processes, different delivery times may apply.
7.6 Deliveries are made between 9:00 AM and 6:30 PM, and it is not possible to specify the exact time of delivery. On the day before the shipment of the order, you will receive an email with the invoice and further information about the shipping and delivery conditions. The products will only be delivered in person and cannot be left at entrances, porches, or other places outside the house.

7.7 Usually, shipments are made through the carrier with whom Ethikos Professional Services LDA works. Shipping costs are calculated on a case-by-case basis. At the time of order confirmation, the customer will be informed of the amount.

 

8. WARRANTY/COMPLAINTS

Article 4 of Decree-Law 24/2014, dated 17-02, as amended by Law 47/2014, dated 28-07.

8.1 The Customer always has the legal warranty rights for equipment that the law requires, for a period of two years from the delivery of the product, under the terms and conditions of the law.

8.2 If you wish to make a claim under an additional warranty provided by Vita Equestrian, you must inform Ethikos Professional Services LDA of the defect as soon as possible and, in any case, within 2 (two) months after it was reasonably possible to discover the defect, under penalty of losing the right to make any claim under the warranty. Claims relating to perishable products must be made within 48 (forty-eight) hours after delivery.

8.3 Under the additional warranty provided by Ethikos Professional Services LDA for its own brand products, claims can be made for material or manufacturing defects. A valid claim will result in free repair or replacement of the products, at the discretion of Ethikos Professional Services LDA. If repair or replacement is not possible or reasonable, considering the costs involved, Ethikos Professional Services LDA has the right, as a final solution, to reimburse the costs.

8.4 After reporting the defect, the Customer must allow Ethikos Professional Services LDA to inspect the Products. The inspection of the defective Product takes place at the facilities of Ethikos Professional Services LDA. The costs of transportation/return are borne by Vita Equestrian, unless the claim under the warranty is denied, in which case the Customer must pay the transportation costs.

8.5 Any defects in the Products resulting from normal wear and tear or any other external cause, such as, but not limited to, damage due to transportation carried out by the Customer, improper use, or if the Customer has made any repairs to the product without the prior written authorization from Vita Equestrian, will not be covered by the warranty unless such use or repairs are inherent to the use of the Products.

 

9. LIABILITY AND INDEMNIFICATION

Article 4 of Decree-Law 24/2014, dated 17-02, as amended by Law 47/2014, dated 28-07.

9.1 The liability of Ethikos Professional Services LDA is limited to the extent permitted by law. Ethikos Professional Services LDA will never be liable for any damage to the Customer if:
a. The damages result from non-compliance with the liability of the manufacturer, unless Ethikos Professional Services LDA is legally liable under the law;
b. The damages are indirect and/or consequential.

9.2 If damages occur, the Customer is obliged to limit any additional or other damages as reasonably as possible.

 

10. RIGHT OF RETURN / TERMINATION

Articles 4, 10 to 14, and 17 of Decree-Law 24/2014, dated 17-02, as amended by Law 47/2014, dated 28-07.

10.1 The Customer has the right to terminate the contract within 14 days from the day the Customer or a third party, other than the carrier, acquires physical possession of the goods, or from the day of the last good in the case of multiple goods ordered in one order and delivered separately. You can exercise the right of termination by sending a clear statement to Ethikos Professional Services LDA, Rua Engenheiro Carlos Santos, 28 Montemor, Loures, 2670-502 Loures, indicating your decision to terminate this contract by an unequivocal statement (for example, a letter sent by mail, fax, or email) before the aforementioned deadline. You may use the attached model termination form.

Effects of termination
If the Customer terminates the contract, we will refund all payments received, including delivery costs (except for any additional costs resulting from the Customer’s choice of a different type of delivery than the least expensive type of standard delivery offered by us), without undue delay and, in any case, no later than 14 days from the day we are informed of the decision to terminate the contract. We will carry out such refund using the same means of payment as the Customer used for the initial transaction, unless expressly agreed otherwise, and in any event, the Customer will not incur any fees as a result of such refund. We may withhold the refund until we have received the returned Products or until the Customer has supplied evidence of having sent back the goods, whichever is the earliest.

Return of goods
If the Customer chooses to exercise the right of termination, the Customer must bear the cost of returning the goods.

Liability and Warranty
The Customer shall only be liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

10.2 To exercise the right of termination, you may use the model termination form attached to these Terms, which can also be found on the Website. Alternatively, you may terminate the contract by issuing an unequivocal statement to Ethikos Professional Services LDA declaring your intention to terminate the contract.

10.3 All products containing consumables (e.g., cartridges, ribbons, or toners) can only be exchanged/returned upon the replacement of these consumables. Ethikos Professional Services LDA reserves the right to charge/retain the costs for the content of these consumables used by the Customer.

10.4 Your right of termination does not apply to: the supply of products made to the consumer’s specifications or clearly personalized; the supply of products liable to deteriorate rapidly; the supply of sealed goods that are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery; the supply of sealed audio or sealed video recordings or sealed computer software, which were unsealed after delivery; the supply of digital content that is not supplied on a tangible medium if the performance has begun with the consumer’s prior express consent and acknowledgment that the consumer thereby loses the right of withdrawal; unsealed cartridges and other consumables (toners/ribbons/ink) not described in clause 10.3 unless they are defective.
